But as I wrote here, I think it is proper to the authority of the state to make illegal such acts, for the sake of common good. Discrimination may not be opposed to commutative justice, but it is opposed to general justice. Some instances of discrimination may be opposed to distributive justice as well, especially if the agent distributing the common good on the basis of skin color alone is the government. While one would not want to rely solely upon written law in order to integrate a society, it can be a tool for such.

Nonetheless, the authority to make such a law seems to lie with the states, and not with the Federal [i.e. National] Government.
